Hereinafter: ‘In4Care’
Article 1: General Provisions
Through its website (www.in4care.be), In4Care vzw (hereinafter “In4care”, “we” or “us”) provides the opportunity to purchase memberships, tickets and other products and services online.
These general conditions apply to any offer, proposal, quotation, order, agreement, invoice or service relating to the supply of goods or services, including memberships, partnerships, ticket sales at events1 and the like, by In4Care to a Customer (hereinafter “Services”). “Customer” means any legal or natural person using In4Care’s Services in the exercise of a profession or business, as well as their representatives and agents. For the avoidance of doubt, In4Care’s Customers do not consist of private consumers.
In applying for or purchasing a Service from In4Care, the Customer expressly accepts these terms and agrees to: the applicability of these terms; the exclusion of all other terms and conditions and the replacement of all previously made arrangements or agreements. General terms and conditions of the Customer himself are excluded. Deviations from these terms and conditions shall only be valid if expressly agreed in writing between In4Care and the Client. The Customer may not assign the contract to a third party except with the prior written consent of In4Care.
Any invalidity of one or more provision(s) of these terms and conditions shall not affect the validity of the remaining provisions. Failure to invoke a right or sanction does not constitute a waiver.
In4Care reserves the right to amend these terms and conditions at any time, without giving reasons. In the event of an amendment, In4Care shall inform the Client of the amended text of the general terms and conditions. As the case may be, this can be done through a general communication on our website.
Article 2: Price
All prices are expressed in euros, excluding VAT and other taxes or duties. Any delivery, reservation or administrative costs are stated separately.
Article 3: Offer
Despite the care taken in compiling the offer, the information may be incomplete, incorrect or not up to date. Obvious mistakes or errors in the offer are not binding. In4Care is only bound by an obligation of means regarding the accuracy and completeness of the information and cannot be held liable for manifest material errors, typesetting or printing errors.The content of the offer and of any other information on our website is not tailored to your personal situation or specific circumstances and therefore cannot be regarded as personal advice.
The offer may be amended or withdrawn at any time without notice. If an offer has a limited period of validity or is made subject to conditions, this will be explicitly stated.
Article 4: Specific provisions for memberships.
Membership commences on the billing date of the annual membership fee invoice. Membership is concluded for an initial term of 12 months. Unless cancelled in writing by the Customer no later than one month before the annual membership expiration date, membership is automatically renewed for successive periods of 12 months each. Termination must be made in writing, either by mail or e-mail to [email protected].
Article 5: Specific provisions for partnerships
If you wish to enter into a partnership with us, there will always be a separate partnership agreement between you and In4Care, setting forth specific terms, rights and obligations.
Partnerships are not equivalent to a standard membership and may include additional or different benefits, rates and terms.
Cooperation starts from the signing of the partnership agreement or from payment of the agreed partnership invoice, whichever comes first.
Partnerships are valid for the agreed term and are renewed only if expressly confirmed in writing by both parties.
All general terms and conditions of In4Care also apply to partnerships, unless explicitly waived in writing.
The termination or non-renewal of a partnership agreement does not impact the partner’s separate membership with In4Care. Membership shall be maintained on the terms set forth in Article 4, unless terminated by the Customer itself in accordance with those terms.
Article 6: Cancellation
The Customer has the right to cancel a contract for any of our Services (e.g. membership, partnership or purchase of other products or services) within 3 business days of its conclusion. However, if you purchase a Service in the capacity of a consumer, you have a right of withdrawal of 14 days after conclusion of the agreement or receipt of the product in question. Cancellation must be made in writing and unambiguously via mail or e-mail([email protected]).
Events are subject to the specific cancellation rules set forth in Article 15.
Article 7: Force Majeure
In the event of force majeure, In4Care may temporarily suspend its obligations or terminate the contract without compensation. Force majeure does not entitle the Customer to compensation from the organizer or refund of the amounts paid by him (membership, tickets, etc.). Force majeure means any circumstance beyond the control of In4Care that prevents the performance of all or part of its obligations, such as strikes, insurrection, pandemics, terrorism, shortage of means of transport, general scarcity of raw materials, fire, power failures or limitations in energy consumption disruption of Internet, computer network or telecommunications services and force majeure of suppliers.
If the force majeure situation lasts longer than three months, either party may terminate the agreement by registered letter, without being liable for compensation.
Article 8: Customer and complaint service
In4Care customer service can be reached at +32 470 12 27 37, at [email protected] or by mail at Antwerpselaan 1, 1853 Grimbergen.
Any complaints must be made by the Customer via mail or e-mail ([email protected]) and justified within 15 calendar days after delivery or discovery of an alleged defect. Complaints or protests relating to invoices must be sent by registered mail within 7 calendar days. The filing of a complaint does not release the Customer from his payment obligations.
Article 9: Payment term
Invoices are payable within 30 days of invoice date, unless otherwise agreed. In the event of non-payment or late payment, interest of 10% per annum shall be due by operation of law and without notice of default. In4Care may in that case suspend its obligations and terminate current contracts.
Article 10: Intellectual Property
In4Care grants the Customer a limited, non-exclusive, non-transferable and revocable license to use the In4Care website to access and purchase Services. You may not copy, modify, reproduce or unauthorizedly exploit any of the content on the website.
All content may be protected by copyrights, trademarks or other intellectual property rights. Any rights not expressly granted are reserved.
Article 11: Protection of Personal Data.
In4Care respects the Belgian legislation on data protection. The personal data communicated by the Client as part of the use of the website and/or requesting or purchasing one of our Services, are only used for the correct processing and follow-up of the requested or purchased Services. More information can be found in the Privacy Statement of In4Care.
Article 12: Proof
The Customer accepts that electronic communications and backups may serve as evidence.
Article 13: Liability
In4Care uses its best efforts to maintain and protect this website from computer viruses, interruptions, network errors or any other form of interference. Nevertheless, we cannot exclude the possibility of unauthorized technical actions or unauthorized interventions by third parties. We also cannot guarantee uninterrupted access to the website. In4Care can in no way be held liable for any malfunction or temporary (un)availability of the website or for any form of damage, direct or indirect, which would result from the access to or use of the website. In4Care also cannot be held liable for any inaccuracies or incompleteness of the information made available on our website.
The website may contain hyperlinks to websites or web pages of third parties, or refer to them indirectly. The placing of hyperlinks to these websites or web pages in no way implies an implicit approval of their content. In4Care cannot be held liable for the content available via third-party websites by means of hyperlinks placed on the website, nor for the processing of personal data via these hyperlinks. The reference by In4Care to a hyperlink via the website does not necessarily imply a collaboration between In4Care and the holder or owner of that hyperlink and the underlying website.
In4Care shall not be liable for any indirect damages, including (but not limited to) loss of data, revenue or profit. In the event of In4Care’s liability (regardless of the severity of the breach), it shall be limited per cause of loss to no more than the invoice amount of the relevant service or product purchased (in the case of Services with a one-time price or one-time purchase); or to no more than the total amount paid by the Customer to In4Care for the relevant Service during the twelve (12) months preceding the event causing loss (for Services with a recurring price, such as an annual membership).
The limitations of liability of In4Care contained in this article shall not apply to damage caused in bad faith by In4Care. The limitations of liability contained in this article shall always be interpreted in such a way as to be legally valid. If a limitation of liability included in this article would not be legally valid in certain circumstances, these circumstances shall be deemed not to be intended.
Article 14: Applicable law – disputes
Belgian law applies to these terms and conditions. The courts of Brussels-Halle-Vilvoorde have exclusive jurisdiction in the event of disputes.
Article 15: Events
Registration
Event registration is generally done through the online registration form on the website or through Bundeling’s member app (the In4Care Community App).Exceptionally, registration may be through another online tool, such as Microsoft Forms or a similar form.
- Cancellation and replacement
Cancellations less than 7 calendar days before the event will not be refunded.
Participants may, however, be replaced by a colleague free of charge, provided that the name of the substitute is notified no later than 3 days before the event. If this is done later or in case of absence without notice, the no-show fee will be charged.
- No-show fee
A no-show fee will be charged in the following cases:
For free tickets (as applicable to members);
When a ticket was ordered but has not yet been paid for.
An order is considered binding as soon as the participant, or a person authorized by him (such as an executive, colleague or representative of the organization), confirms in writing that he wishes to participate in the event.
“Written” means any communication via email, online form, WhatsApp, text message or other electronic messaging with the In4Care team.
If the participant does not subsequently attend the event and does not provide a timely cancellation or replacement according to the above mentioned cancellation terms, a no-show fee will automatically be charged.
The amount of the no-show fee is always stated on the event page or in event communications.
By registering, the participant agrees to these terms and conditions.
- Participant List
By registering, the participant accepts that their name and organization will be listed on the participant list. This list will only be shared with other participants in the same event. Your e-mail address and other contact information will never be shared. Those who wish to do so may, upon simple request via [email protected], request that their information not be placed on the list.
- Other provisions
In4Care reserves the right to cancel, reschedule or modify the content of the event. Participants will be notified in a timely manner.
Photo and visual material
Photo and video footage may be taken during In4Care events for reporting and communication (website, social media, newsletters and print materials).
By registering for an event, the participant declares to be aware of and agree to this.
Those who do not wish to appear recognizable in the picture can explicitly notify the organization in advance or on site. In4Care will take this into account to the extent possible. For specific portrait photos or interviews, permission can always be requested separately.
Article 16: Specific provisions for Living Lab activities.
Participation in In4Care’s Living Lab activities is always voluntary. Participants register for each study, in the manner determined by In4Care. Participation may be discontinued at any time and without giving reasons, without giving rise to any compensation or damages on the part of In4care.
Participation is free of charge. No compensation will be provided, either in cash or in the form of expense reimbursements, unless expressly notified in advance and in writing by In4Care.
Travel to and from the test site is entirely at the participant’s own risk and responsibility. Under no circumstances shall In4Care be held liable for accidents or damages occurring during or as a result of such travel.
During the test moments, In4Care provides the necessary safety measures and works with prototypes, test equipment and methodologies that are used exclusively for research and development purposes. Both In4Care and participants undertake to act with due diligence and caution in this regard. Participants also undertake to comply strictly with the instructions provided. In4Care cannot be held liable for accidents or damage resulting from improper use of materials or failure to comply with instructions.
If a separate informed consent form (ICF) is required for certain research activities, the participant will receive and sign it in advance. The ICF supplements these general terms and conditions.
If personal data or visual material is collected during the activities, this will always be done in accordance with applicable privacy laws and in accordance with the provisions of our Privacy Statement.
Article 17: Offer conditions for service Living Lab
Quotations and validity
Quotations are always tailored in consultation with the Customer and are valid for 14 days.
Payment terms
For financial clarity, In4Care uses the principle: 50% payment upon signing the quotation and 50% after delivery of services, unless otherwise agreed.
Pricing Policy
The rates listed are subject to change based on indexing or changing personnel costs.
Currently, a standard hourly rate of €95 per hour is in effect for care trial garden staff.
Any additional costs, such as meeting room rental, shipping of products or other necessary expenses, will be charged directly to the Client.
Member discount
Members of In4Care enjoy a 20% discount on all care trial garden services.
VAT
All prices are quoted exclusive of VAT.
